Privacy Policy

This Privacy Policy describes how Peak Aviation Solutions (“Peak,” “we,” “us,” or “our”) collects, uses, and discloses your personal information when you visit https://flypeak.com (the “Site”), use our services, request a quote, book a charter, or otherwise communicate with us (collectively, the “Services”). “You” and “your” means any user of the Services — a client, website visitor, or other individual whose information we collect.

By using and accessing the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree, please do not use or access the Services.

Changes to this policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will post the revised policy on the Site, update the “Last updated” date, and take any other steps required by applicable law.

How we collect and use your information

To provide the Services, we collect personal information about you from a variety of sources. What we collect varies depending on how you interact with us. We may also use your information to communicate with you, provide the Services, comply with applicable legal obligations, enforce our terms, and protect or defend the Services and the rights of our users and others.

What personal information we collect

Information you provide directly may include:

  • Basic contact details — your name, address, phone number, and email.
  • Charter request and booking information — travel details, billing information, payment confirmation, and the contact details needed to arrange your flight.
  • Account information — username, password, and security questions, if you create an account.
  • Customer support information — anything you choose to include when you contact us.

Information we collect through cookies. We automatically collect certain information about your interaction with the Services (“Usage Data”) using cookies, pixels, and similar technologies — including device and browser information, your network connection, your IP address, and how you use the Site.

Information we obtain from third parties. We may receive information about you from vendors and service providers who collect it on our behalf, such as:

  • Providers that host and support our Site and Services.
  • Payment processors that collect payment information (e.g., bank account, credit or debit card, and billing address) to process your payment and provide the services you request.
  • Advertising and analytics partners that automatically collect information when you visit the Site or interact with our emails and advertisements, using pixels, web beacons, software development kits, and cookies.

Any information we obtain from third parties is treated in accordance with this Privacy Policy. We are not responsible for third parties’ policies or practices.

How we use your information

  • Providing the Services — to process your charter requests and payments, arrange your flights, create and manage your account, and respond to your transactions.
  • Marketing and advertising — to send communications by email, text message, or postal mail, and to show you relevant advertising, including tailoring the Services and advertising to you.
  • Security and fraud prevention — to detect, investigate, and act on possible fraudulent, illegal, or malicious activity. Keep your account credentials safe and contact us if you believe your account has been compromised.
  • Communicating with you — to provide customer support and improve the Services.
  • SMS/MMS consent — by providing your mobile number, you consent to receive SMS/MMS communications from Peak Aviation Solutions, LLC. Opt out anytime by replying STOP.
  • Privacy and data security — your mobile contact information and opt-in data will not be shared or sold to third parties or affiliates for marketing purposes.
  • Opt-out — reply STOP to any message to stop SMS/MMS communications.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. These categories exclude SMS opt-in data and consent, which will not be shared with any third parties.

How we disclose personal information

We may disclose your personal information to third parties for legitimate purposes, including:

  • Vendors and service providers who perform services on our behalf (e.g., IT management, payment processing, data analytics, customer support, and cloud storage).
  • Business and marketing partners, to provide and advertise our Services.
  • Parties you direct, request, or consent to, such as through social media widgets or login integrations.
  • Our affiliates or others within our corporate group.
  • In connection with a business transaction such as a merger or bankruptcy; to comply with legal obligations (including subpoenas, warrants, and similar requests); to enforce our terms; and to protect our rights and those of our users and others.

In the past 12 months we have disclosed the following categories of personal information for the purposes described above: identifiers (basic contact and account details); commercial information (charter requests and customer support records); and internet or network activity (Usage Data) — to vendors and service providers, business and marketing partners, and affiliates. We do not use or disclose sensitive personal information to infer characteristics about you.

User-generated content

The Services may allow you to submit content in public areas. Anything you post publicly is accessible by others; we cannot control who accesses it or ensure its security, and we are not responsible for information you choose to make public or share with third parties.

Your rights and choices

Depending on where you live, you may have some or all of the rights below. These rights are not absolute and may apply only in certain circumstances:

  • Access / know — request access to the personal information we hold about you.
  • Delete — request that we delete your personal information.
  • Correct — request that we correct inaccurate personal information.
  • Portability — request a copy of your information or that we transfer it to a third party, in certain circumstances.
  • Opt out of sale, sharing, or targeted advertising — direct us not to “sell” or “share” your personal information. If you visit with Global Privacy Control enabled, we treat it as an opt-out request for that browser or device where applicable.
  • Limit use of sensitive personal information — to what is necessary to provide the Services.
  • Restrict processing, withdraw consent, and appeal a declined request.
  • Manage communication preferences — opt out of promotional email anytime via the unsubscribe link; we may still send non-promotional messages about your account or bookings.

To exercise these rights, use the options on our Site or contact us using the details below. We will not discriminate against you for exercising your rights. We may need to verify your identity before responding. You may use an authorized agent, with proof of authorization, to make a request on your behalf.

Security and retention

No security measures are perfect or impenetrable, and information sent to us may not be secure in transit — please do not use unsecure channels to share sensitive or confidential information. We retain your personal information for as long as needed to provide the Services, maintain your account, comply with legal obligations, resolve disputes, and enforce our agreements.

Children’s data

The Services are not intended for children, and we do not knowingly collect personal information from children. A parent or guardian may contact us to request deletion. As of the effective date of this policy, we have no actual knowledge that we “sell” or “share” the personal information of individuals under 16 years of age.

Third-party websites and links

Our Site may link to third-party websites or platforms. We do not control and are not responsible for their privacy or security practices; please review their policies before sharing information. Our inclusion of a link does not imply endorsement.

International users

We may transfer, store, and process your personal information outside the country you live in, including the United States. Where we transfer information out of Europe, we rely on recognized transfer mechanisms such as the European Commission’s Standard Contractual Clauses (or UK equivalents), unless the transfer is to a country determined to provide an adequate level of protection.
